To clarify the issue, the only penalty (suspension until compliance) in 6-07(f) is for not either having a vehicle or not being in contract with a company with a vehicle.

As presently written, there is no penalty for failing to provide equivalent service. So all a company has to do is appear with a signed contract and they will be found not guilty. A few judges are getting more creative and adding additional code violations, which carry their own fines.

The TLC intends to strengthen the equivalent service part of the regulation in FY 06 (7/1/05 - 6/30/06)
